Welcome to FluxRender. These Terms and Conditions (“Agreement”, “Terms”) govern your access to and use of the FluxRender platform, website, applications, and cloud rendering services.
This Agreement is entered into between NEO CLOUD INNOVATIONS PRIVATE LIMITED, operating as FluxRender (“FluxRender”, “Company”, “we”, “our”, or “us”), and the individual or entity using the Services (“User”, “you”, or “your”).
By accessing or using the Services available at https://fluxrender.io/, creating an account, or using any FluxRender application or infrastructure, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
If you do not agree with these Terms, you must not use the Services.
1. Definitions
1.1 Services
“Services” means the cloud-based rendering, workstation, storage, compute, streaming, and related infrastructure services provided by FluxRender through its platform and applications.
1.2 Applications
“Applications” means the FluxRender website, desktop applications, APIs, dashboards, portals, and any related software interfaces.
1.3 Workstation
“Workstation” means the virtual machine, render node, compute environment, or cloud infrastructure allocated to the User through the Services.
1.4 User Content
“User Content” means all files, scenes, textures, assets, renders, source files, data, scripts, code, and other materials uploaded, processed, stored, or generated by the User through the Services.
1.5 Service Fees
“Service Fees” include subscription fees, rendering usage charges, storage fees, licensing fees, outbound transfer charges, add-on service charges, and any applicable taxes.
1.6 Server Providers
“Server Providers” means third-party infrastructure providers including cloud, compute, networking, storage, CDN, or virtualization providers used by FluxRender.
1.7 Payment Providers
“Payment Providers” means third-party payment processors including but not limited to Stripe and Razorpay.
2. Services
2.1 Service Availability
FluxRender provides cloud rendering and related infrastructure services on a commercially reasonable basis. Service availability may vary depending on infrastructure availability, maintenance schedules, third-party provider limitations, network conditions, and force majeure events.
2.2 Technical Support
FluxRender may provide technical support, onboarding assistance, troubleshooting, or configuration assistance at its discretion.
2.3 Service Modifications
FluxRender reserves the right to modify, suspend, discontinue, improve, or remove any feature or functionality of the Services at any time without liability.
2.4 Beta Features
Certain features may be identified as “Beta”, “Experimental”, or “Preview” features. Such features may contain bugs, errors, interruptions, or limitations and are provided on an “as-is” basis without warranties or guarantees.
2.5 Eligibility
You may only use the Services if:
You are legally capable of entering into binding agreements;
You are at least 18 years old or have valid parental/legal authorization;
Your use of the Services complies with applicable laws and regulations.
3. Account Registration
3.1 Account Creation
Users must register an account using a valid email address and password.
3.2 Account Security
You are solely responsible for:
Maintaining account confidentiality;
Securing login credentials;
All activities conducted under your account.
3.3 Accurate Information
You agree to provide accurate, current, and complete information and to update such information when necessary.
4. How the Platform Works
4.1 Workstation Allocation
After selecting a Service Package, FluxRender allocates cloud resources and/or rendering infrastructure based on User requirements.
4.2 Remote Access
Workstations may be accessed through desktop applications, web interfaces, APIs, or streaming protocols.
4.3 Performance Variability
Performance, rendering speed, upload speed, download speed, latency, and availability may vary depending on:
User location;
Internet connectivity;
Cloud provider performance;
Infrastructure load;
Third-party systems;
Force majeure events.
FluxRender does not guarantee uninterrupted or error-free Services.
5. Storage & Data Handling
5.1 Storage Providers
FluxRender utilizes third-party storage and streaming technologies including but not limited to cloud object storage and file streaming infrastructure providers.
5.2 LucidLink Integration
User data uploads, synchronization, and streaming workflows may utilize LucidLink infrastructure or related technologies for cloud-based file access and streaming.
5.3 Bubble.io Platform
Parts of the FluxRender platform, including application logic, workflows, or database operations, may utilize Bubble infrastructure and services.
5.4 User Responsibility
Users are solely responsible for:
Maintaining backups of critical files;
Verifying uploaded data;
Ensuring uploaded files are free from malware or malicious code.
FluxRender is not liable for data corruption, file loss, rendering errors, failed uploads, failed downloads, or infrastructure failures.
6. User Responsibilities & Acceptable Use
You agree NOT to:
Use the Services for unlawful purposes;
Upload malicious software, ransomware, spyware, or viruses;
Attempt unauthorized access to systems or accounts;
Reverse engineer, bypass, or compromise platform security;
Use unlicensed software;
Infringe intellectual property rights;
Upload illegal, abusive, harmful, or prohibited content;
Interfere with infrastructure performance or stability.
FluxRender reserves the right to suspend or terminate accounts violating these Terms.
7. Third-Party Software & Licensing
7.1 Third-Party Software
Users are solely responsible for obtaining and maintaining valid licenses for any third-party software, plugins, render engines, assets, or tools used through the Services.
7.2 No Liability
FluxRender is not responsible for:
Third-party licensing disputes;
Unauthorized software use;
Software compatibility issues;
Third-party service outages.
7.3 Supported Applications
FluxRender may provide optional installation assistance for supported applications and plugins; however, Users remain fully responsible for compliance with applicable license agreements.
8. Intellectual Property
8.1 Ownership of User Content
Users retain all ownership rights to their User Content.
8.2 Platform Ownership
FluxRender retains all rights, title, and interest in:
Platform software;
APIs;
Branding;
Logos;
Infrastructure;
Designs;
Documentation;
Internal systems;
Related intellectual property.
8.3 Limited License
FluxRender grants Users a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely in accordance with these Terms.
9. Security
9.1 Security Measures
FluxRender implements commercially reasonable administrative, technical, and organizational security measures.
9.2 No Absolute Security Guarantee
No internet-based service is fully secure. Users acknowledge that FluxRender cannot guarantee absolute security or uninterrupted availability.
9.3 Access to User Data
FluxRender may access User Content only when reasonably necessary to:
Comply with legal obligations;
Respond to lawful government requests;
Investigate abuse or security incidents;
Protect platform integrity;
Provide requested support services.
10. Fees & Payments
10.1 Billing
Users agree to pay all applicable Service Fees associated with their use of the Services.
10.2 Usage Charges
Charges may include:
Compute usage;
Render node usage;
GPU/CPU usage;
Storage consumption;
Bandwidth usage;
Licensing costs;
Additional infrastructure costs.
10.3 Payment Providers
Payments are processed through third-party payment processors including Stripe and Razorpay.
10.4 Taxes
Applicable taxes, duties, levies, GST, VAT, or other governmental charges may apply and shall be borne by the User.
10.5 Failed Payments
FluxRender reserves the right to suspend Services in case of failed, disputed, or overdue payments.
11. Refund Policy
11.1 Subscription Refunds
Subscription refunds may be provided as follows:
Within 24 hours: 100% refund;
Within 24–48 hours: 50% refund;
Within 48–72 hours: 25% refund;
After 72 hours: Non-refundable.
11.2 Usage Charges
Rendering usage charges, compute charges, bandwidth charges, and completed infrastructure usage are non-refundable.
11.3 Trial Services
Trial plans, promotional credits, and beta usage fees are non-refundable unless explicitly stated otherwise.
12. Confidentiality
Both parties agree to maintain the confidentiality of non-public information disclosed during the use of the Services.
Confidential information shall not include information that:
Is publicly available;
Was lawfully known prior to disclosure;
Is independently developed;
Is required to be disclosed by law.
13. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”.
FluxRender DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING:
MERCHANTABILITY;
FITNESS FOR A PARTICULAR PURPOSE;
NON-INFRINGEMENT;
DATA AVAILABILITY;
SYSTEM UPTIME;
ERROR-FREE OPERATION.
Users use the Services entirely at their own risk.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FluxRender SHALL NOT BE LIABLE FOR:
INDIRECT DAMAGES;
INCIDENTAL DAMAGES;
LOSS OF PROFITS;
LOSS OF BUSINESS;
LOSS OF DATA;
SERVICE INTERRUPTIONS;
INFRASTRUCTURE FAILURES;
THIRD-PARTY FAILURES;
SECURITY BREACHES;
RENDERING FAILURES.
FluxRender’s total liability shall not exceed the amount paid by the User to FluxRender during the preceding three (3) months.
15. Indemnification
Users agree to indemnify and hold harmless FluxRender, its affiliates, directors, employees, contractors, and partners from claims, damages, liabilities, costs, or expenses arising from:
User Content;
Violation of these Terms;
Infringement of third-party rights;
Misuse of the Services.
16. Suspension & Termination
FluxRender may suspend or terminate access immediately if:
The User violates these Terms;
Fraudulent activity is suspected;
Required by law;
Infrastructure abuse is detected;
Payment obligations are not fulfilled.
Upon termination, FluxRender may permanently delete User data after a reasonable retention period.
17. Modifications to Terms
FluxRender reserves the right to modify these Terms at any time.
Updated Terms become effective upon publication on the website or notification through email or platform notice. Continued use of the Services constitutes acceptance of the updated Terms.
18. Governing Law & Jurisdiction
These Terms shall be governed by and interpreted under the laws of India and the State of Gujarat.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Gujarat, India.
19. Force Majeure
FluxRender shall not be liable for delays or failures caused by events beyond reasonable control, including:
Natural disasters;
Internet failures;
Cloud provider outages;
Government actions;
Cyberattacks;
Labor disputes;
War;
Epidemics;
Infrastructure failures.
